Definitions

Feathers Lifestyle ( FLS ) referred to as “The Company”; Third Party Provider referred to as “The Hirer”; The Organisation entering into this contract with FLS referred to as “The Client”.

Quotation

The Company’s quotations are valid for up to 1 (one) month from the date of quotation and all quotes are subject to VAT, unless otherwise stated.

Payment

(a) A deposit invoice of ( see web advert ) of the set budget will be submitted and payment due a month prior to the event. (b) Once a final invoice for the balance payment is submitted, please note our terms of business are 14 days. (c) FLS reserves the right to charge interest on any outstanding amounts at the rate of 2% per month from the due date until payment is received in full.

Cancellation

Cancellation charges based on the agreed quotation, are payable by The Client for any cancellation of a confirmed event. The minimum cancellation charge is 25%, increasing to 50% within 1 (one) calendar month and 100% within 14 (fourteen) days of the event.

Loss or damage

The hirer is wholly responsible for all equipment from the time of delivery until it is collected. Whilst FLS takes every possible care with the suppliers equipment, any breakage, loss or damage, however caused, will be charged to The Hirer at the full replacement cost.

Complaints

Any complaint must be received by The Company in writing not more than seven days from the date of the function concerned.

Force Majeure

While every effort will be made by The Company to carry out any order accepted, the full performance of it is subject to variation or cancellation by The Company consequent on Act of God, War, Strikes, Riots, Lock-outs or other labour disturbances. Fire, flood, restriction on the use of transport, Fuel or Power, Requisitioning, shortage of material or transport or labour or any other causes beyond the control of The Company. In the event of frustration of the contract due to any of the above causes the contract shall be deemed to be complete and on the company giving notice to that effect the client shall be liable to indemnify The Company and pay them a sum equivalent to the aggregate of the cost incurred by The Company in labour and material sub-contracts and incidentals up to the date of notice, plus 10%.

Law Of Contract

The performance, the validity, construction and all aspects of the order shall be governed by English Law and the parties agree to submit to exclusive jurisdiction of the English Courts.
